These Terms and Conditions of Sale (the “Terms”) set out the rights and obligations of the parties for the distance selling of products offered by SAS DB BASKET CONNECTION on www.basket-connection.fr.

In business since 1994, DB BASKET CONNECTION has spent more than 30 years offering quality products designed specifically for basketball, with particular attention to performance and durability.

DB BASKET CONNECTION reserves the right to amend these Terms at any time. The Terms that apply are those in force on the date the customer confirms the order, as available on the website on that date.

In accordance with Articles L111-1 and L221-5 of the French Consumer Code, which require full pre-contractual information, the seller is identified as follows:

The products available on www.basket-connection.fr are selected exclusively for basketball. Our stock is updated regularly, but strong demand may occasionally lead to unforeseen stock shortages.

Product photos and visuals are for illustration only and may show slight colour differences due to screen display settings. Such minor differences do not constitute a lack of conformity within the meaning of Article L217-4 of the French Consumer Code.

Prices shown on www.basket-connection.fr are in euros (€), including all taxes, in accordance with Article L112-1 of the French Consumer Code.

• Shipping costs are not included in product prices. They are calculated and shown separately before the order is finally confirmed, in accordance with Article L221-5 of the French Consumer Code.
• DB BASKET CONNECTION reserves the right to change its prices at any time. The price charged is the one in force when the customer confirms the order.
• In accordance with EU Directive 2019/2161 (Omnibus), as transposed into French law, whenever a price reduction is announced, the reference price shown is the lowest price charged during the 30 days before the promotion.

To place an order on www.basket-connection.fr, the customer follows these steps:

1. Create a customer account or sign in;
2. Select products and confirm the basket;
3. Enter delivery details;
4. Choose a payment method and pay securely;
5. Final confirmation of the order.

DB BASKET CONNECTION reserves the right to refuse or cancel any order in the event of a dispute over payment of a previous order, proven suspected fraud, or product unavailability discovered after confirmation. The customer will be informed by email and refunded in full if payment has been taken.

Payment is due in full when the order is confirmed. The following payment methods are accepted:

• Bank card (Visa, Mastercard, CB) — with 3D Secure authentication;
• PayPal;
• Klarna — interest-free instalments, subject to approval by Klarna;
• Bank transfer (the order is processed once the transfer is received).

If a fraudulent or unauthorised payment appears on your bank account, you are protected by Article L133-18 of the French Monetary and Financial Code (refund by your bank within one business day). Contact your bank and our customer service immediately.

Orders are shipped to the delivery address given by the customer when ordering. DB BASKET CONNECTION cannot be held responsible for delivery errors caused by an incorrect or incomplete address provided by the customer.

• Delivery times shown when ordering are indicative.
• A tracking number is sent to the customer as soon as the order is shipped.
• Delivery costs are paid by the customer unless a promotional offer applies.
• For deliveries outside mainland France, additional costs and longer delivery times may apply. Customs duties or import taxes may be payable on delivery and are the sole responsibility of the recipient.

Full details are given on our dedicated page. The provisions below form the applicable contractual framework and are consistent with, and do not contradict, that page.

8.1 – Legal right of withdrawal (14 days)

The refund is made no later than 14 days after receipt of the returned product, using the same payment method as for the purchase, in accordance with Article L221-24 of the French Consumer Code. Original delivery costs are not refunded. Return shipping costs are paid by the customer.

8.2 – Basket Connection extended return policy (30 days)

8.3 – Return procedure

1. Send your request by email to service@basket-connection.fr, stating your order number and the reason for the return.
2. Pack the item in its original packaging, together with your order number and contact details.
3. Send it by registered, tracked post to: Basket Connection, 3 Quai Félix Faure, 49100 Angers, France.
4. Keep your proof of postage until you receive your refund.

8.4 – Return shipping costs

• Our mistake or lack of conformity: costs paid by Basket Connection (prepaid label provided).
• Other cases (change of mind, size): costs paid by the customer.
• Returns from outside mainland France: always paid by the customer.

8.5 – Store credit

Instead of a refund, the customer may ask for store credit valid for 1 year on basket-connection.fr, issued as a discount code. The request must be made by email to service@basket-connection.fr when requesting the return.

For any claim under the legal guarantees, contact service@basket-connection.fr with photos of the defect and your order number. In this case, return shipping costs are paid by Basket Connection.

• Gift cards can be used only on basket-connection.fr.
• They can be paid for by bank card, PayPal or bank transfer.
• They are valid for 1 year from the date they are sent to the recipient.
• They are non-refundable and cannot be exchanged for cash, in accordance with Article L112-6 of the French Monetary and Financial Code.
• Once used, gift cards are not subject to the right of withdrawal, in accordance with Article L221-28 of the French Consumer Code.

DB BASKET CONNECTION collects and processes its customers' personal data strictly for the purpose of fulfilling orders and managing the customer relationship.

• The data collected is used only to process orders, manage the customer relationship and, with your explicit consent, send marketing communications.
• Your data is never sold to third parties for commercial purposes.
• Data is kept only as long as necessary for the purposes for which it is processed, in compliance with legal obligations (in particular accounting records: 10 years).

DB BASKET CONNECTION is responsible for the proper performance of the obligations arising from the contract of sale, in accordance with Articles 1217 et seq. of the French Civil Code.

DB BASKET CONNECTION cannot be held liable in the following cases:

• Disruption or interruption of the Internet network beyond our control (intrusion, virus, service outage);
• Use of products for purposes other than those intended (e.g. indoor shoes used outdoors);
• Loss of or damage to a return parcel not sent by registered post by the customer;
• An incorrect email address provided by the customer for a gift card;
• Force majeure within the meaning of Article 1218 of the French Civil Code (an unforeseeable, unavoidable and external event).

In any event, the liability of DB BASKET CONNECTION is limited to the amount of the order concerned.

www.basket-connection.fr is hosted and operated on the Shopify Inc. platform (251 Little Falls Drive, Wilmington, Delaware 19808, United States), one of the most secure e-commerce solutions in the world, used by more than 4 million merchants in over 175 countries.

Shopify acts as technical hosting provider within the meaning of Article 6 of French Law No. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN), and as data processor within the meaning of Article 28 of the GDPR. As such, Shopify is subject to the same data protection obligations as DB BASKET CONNECTION.

The technical security measures implemented by Shopify include:

• TLS/SSL encryption: all communication between your browser and our servers is encrypted, as shown by the padlock 🔒 in the address bar. TLS certificates are provided and renewed automatically by Shopify.
• Card data tokenisation: your card details are immediately replaced by a unique token. No card number is stored on our servers or on Shopify's.
• SOC 1 & SOC 2 audits carried out every 6 months by accredited independent auditors to assess the effectiveness of security controls.
• Quarterly ASV vulnerability scans (Approved Scanning Vendor) in line with PCI DSS requirements.
• Real-time fraud analysis on every order, with a risk assessment before approval.

DB BASKET CONNECTION cannot be held responsible for technical failures attributable to the Shopify platform, within the limits of applicable law. For any question about platform security, see Shopify's official security policy: shopify.com/security.

These Terms are governed by French law. In the event of a dispute about their interpretation or performance, the parties agree to seek an amicable solution before taking any legal action.
